Terms of use and contract

This is a translation for information only; the Spanish version prevails. These terms govern the use of MultiDocs, a service of EXAMFY SOFTWARE, S.L. (full details in the Legal notice). By using the service you accept them. If you don't agree, don't use it.

1. The service

  • Sign for free: lets you sign your documents in your browser and download them or send them by email, without signing up and with no limit.
  • Send for signature: lets you ask someone else to fill in and sign a document, getting the link to them by email (we send it) or by WhatsApp or SMS (you send it from your phone); you receive the signed document by email with a record of the signature. Includes 20 free sends a month.
  • MultiDocs plan: for companies, professionals and organisations, with unlimited users, up to 1,000 documents sent for signature a month and the features described on the website at any given time. A custom price is agreed for higher volumes.

2. Who can use it

You must be over 14. The paid plan is aimed at companies, professionals and organisations; if you take it out on behalf of an organisation, you declare that you can bind it.

3. Proper use

You agree to:

  • Send only documents you have the right to use and ask for signatures only from people with whom you have a legitimate relationship.
  • Have a legal basis for processing the data of the people you send documents to and inform them of this. As regards that data, you are the data controller and EXAMFY SOFTWARE, S.L. is the processor.
  • Not use the service to impersonate anyone, forge documents, send unwanted messages or for any unlawful purpose.
  • Not try to access other people's documents, tamper with the service or overload it.

To send documents for signature or email a signed document, you must confirm your email with a code we send you: this is how we check that the email address is yours. You are responsible for the name you enter, which must be your own or that of the organisation you represent.

We may suspend access for anyone who breaks these rules.

4. The electronic signature

MultiDocs provides a simple electronic signature within the meaning of Regulation (EU) 910/2014 (eIDAS), backed by a record that includes the date and time, the signer's email, the IP address, the browser and the digital fingerprint (SHA-256) of the original document. Under eIDAS, it cannot be denied legal effect just because it is electronic.

Every signed document can be checked at multidocs.es/verificar: if anyone changes it after signing, it no longer matches. We keep the evidence record of each signature (without the document) for 5 years.

It is not an advanced or qualified electronic signature, and EXAMFY SOFTWARE, S.L. is not a qualified trust service provider. It is up to you to decide whether this type of signature is suitable for each document; if a rule requires a qualified signature (for example, with a digital certificate), you must use one.

5. Your documents

Your documents are yours. We only use them to provide the service. Documents sent for signature are deleted from our servers 30 days after signing (or after sending, if they aren't signed): keep the signed document you receive by email.

6. Price and payment

  • Signing your documents and 20 sends for signature a month are free.
  • The MultiDocs plan costs €19 a month or €228 a year, excluding VAT.
  • It is paid in advance and renews automatically at the end of each period unless you cancel it.
  • If we change the price, we will let you know at least 30 days in advance and you can cancel before it applies.

7. Cancellation

There is no tie-in. You can cancel whenever you like and the plan will stay active until the end of the period you've paid for; periods already started are not refunded. When it ends, your account moves to the free plan: you keep access to the documents filed in your account and you get the free sends each month. You can turn the plan back on whenever you like, for example only in your busiest months. As this is a service for companies and professionals, the consumer right of withdrawal does not apply.

8. Availability and changes

We work to keep the service available at all times, but there may be interruptions for maintenance, supplier failures or reasons beyond our control. We may improve or change features; if a change significantly affects the paid plan, we will let you know.

9. Liability

We provide the service with due diligence. We are not liable for the content of the documents, their validity for a particular purpose, how the parties use them, or damage caused by use contrary to these terms. Except in cases of wilful misconduct or gross negligence, our liability to paying customers is limited to the amount paid in the previous 12 months. Nothing here limits the rights the law gives consumers.

10. Personal data

We process data in line with the Privacy policy. For the data of the people you send documents to, the Data processing agreement applies, which forms part of these terms.

11. Changes to these terms

We may update these terms. We will publish the new version with its date and, if the changes are significant and we have your email, we will let you know in advance.

12. Governing law

These terms are governed by Spanish law. If you are a consumer, the courts of your place of residence will have jurisdiction; in all other cases, the courts of Barcelona. For any complaint, please email us first at info@multidocs.es: we'll try to sort it out.
