In 30 seconds

  • From 14, a child can consent to the use of their data themselves; below that age, their parents or guardians sign.
  • Publishing photos of pupils or players on the website or social media needs explicit consent.
  • Offer a tick box for each use (website, social media, magazine) and explain how to withdraw permission.

What the consent form should say

  • Who will use the images (the club or the school) and what for: website, social media, magazine, posters.
  • That consent is voluntary and can be withdrawn at any time.
  • Separate options for each use, so the family can choose.
  • Details of the child and of the person giving consent, date and signature.

What the law says

Two Spanish laws work together. The data protection law sets the age from which the child decides for themselves:

“The processing of a minor’s personal data may only be based on their consent when they are over fourteen years of age.”

Ley Orgánica 3/2018, article 7.1 · See the official source

And the law on the right to one’s own image says who consents when the child can’t:

“Consent from minors and persons lacking capacity must be given by themselves if their maturity allows it, in accordance with civil law.”

Ley Orgánica 1/1982, article 3.1 · See the official source

The Spanish Data Protection Agency applies it like this in schools:

  • Photos and videos taken for educational purposes don’t need consent; those of events for the magazine or website do.
  • To publish photos of pupils on the school’s website, you need consent from the pupils or their parents. Another option is to blur them.
  • Enrolment data can’t be used to publish photos: that’s a different purpose.
  • Families can film the school show for personal use, but not post it publicly without permission.
