How to sign a contract online, remotely
More and more contracts are signed without meeting: a rental with a tenant in another city, a services contract with a client, an agreement between partners. Here’s how to do it with every safeguard.
In 30 seconds
- In Spain, a contract is binding whatever its form, as long as it has consent, subject matter and cause (Código Civil, art. 1278).
- Signing it remotely is valid; what matters is being able to prove who signed and what.
- Some acts require a public deed before a notary: for those, an electronic signature isn’t enough.
Step by step
- Save the contract as a PDF and upload it in Sign for free.
- Choose “Someone else”. Tap “Signature” for the other party and, with “+ Add person”, add anyone else who needs to sign. You can be one of the signers too.
- Add “Name” and “ID number” for each signer, and a “Tick box” if terms need to be accepted.
- Send it by email or WhatsApp. When everyone has signed, each person gets the signed contract with the certificate.
Official figures
Is a contract signed remotely valid?
“Contracts shall be binding, whatever the form in which they were entered into, provided that the essential conditions for their validity are present.”
Código Civil, article 1278 · See the official source
“Contracts are perfected by mere consent, and from then on they bind the parties not only to fulfil what was expressly agreed, but also to all the consequences which, according to their nature, accord with good faith, custom and the law.”
Código Civil, article 1258 · See the official source
Yes. In Spain contracts are perfected by the parties’ consent, and an electronic signature lets you prove it. The certificate records who signed, when, from where and the document’s fingerprint. Some contracts also need a public deed before a notary (for example, the sale of a property so it can be entered in the Land Registry).
Rental contracts
A tenancy agreement signed electronically is valid. It’s best for both parties to sign the same document and for each to keep their copy with the certificate.
