Can You Sign an Employment Contract Electronically in Ireland?

Yes. In Ireland an employment contract needs no particular form: it can be verbal, on paper or electronic. What the law does require is that the employer gives the employee the core terms in writing, signed and dated, within set deadlines. That statement can be signed electronically without any difficulty, and it is standard practice for the employee to sign it too as an acknowledgement. Here are the deadlines, the consent rule and one precaution about the PPS Number.

  • An employment contract needs no particular form in Ireland; the statement of terms (TE(I)A 1994, s. 3) must be signed and dated by the employer.
  • Deadlines: the core terms within 5 days (s. 3(1A)) and the rest within one month (s. 3(1)).
  • An electronic signature is valid with the recipient's consent (ECA 2000, s. 13), which is recorded at the moment of signing.
  • Do not ask for the PPS Number in the contract: collect it through your payroll channel.

What the law requires

The Terms of Employment (Information) Act 1994 (s. 3) requires the employer to give the employee a written statement of the core terms of employment: the basic details (the parties, place of work, job title, start date, expected duration if temporary, pay and hours) within the first 5 days (s. 3(1A)), and the rest within one month (s. 3(1)). Section 3(4) adds that the statement "shall be signed and dated by or on behalf of the employer". It does not require the employee's signature, although it is good practice to have them sign it as an acknowledgement of receipt.

«A statement furnished by an employer under subsection (1) or (1A) shall be signed and dated by or on behalf of the employer.»

The Electronic Commerce Act 2000 (s. 13) allows any legal requirement for a signature to be met with an electronic signature, with the consent of the person receiving it. Opening the link and signing shows that consent, and in MultiDocs it is recorded.

What you can sign electronically

  • The offer letter and the employment contract, whether permanent or fixed-term.
  • The statement of terms under the 1994 Act (signed by the employer and, as an acknowledgement, by the employee).
  • Company policies, confidentiality agreements, intellectual property assignments, personal details forms.
  • Changes to terms, annual leave requests, receipts for equipment.

Unlike Germany, Ireland has no employment documents that call for a qualified signature; the only general limit is deeds (powers of attorney, for example), which we cover in can you sign a deed electronically?

How to get it right

  1. Prepare the contract as a PDF with the core terms required by s. 3 and upload it in Sign for free.
  2. Mark where the employee signs and, if you like, where you sign. Enter their name and their email address or mobile number.
  3. They receive a link; they agree to sign electronically, review it and sign with their finger. If they start on Monday, send it before then: the 5-day deadline runs from the start date.
  4. You receive the signed PDF with its audit trail (email address or mobile number, IP address, date, time and document fingerprint); the employee gets their copy.

Personal data: the PPS Number

You will need it for payroll and Revenue, but do not ask for it in the document to be signed: the Social Welfare Consolidation Act 2005 (s. 262) restricts its use to specified bodies and transactions with them, and requesting it outside that channel can be an offence. Collect it through your payroll channel, not in the contract. If you ask for a photo of an ID document (passport or driving licence; Ireland has no national identity card), only the sender receives it.

FAQs

Does the employee have to sign the employment contract in Ireland?

The law requires the statement of terms to be signed and dated by the employer (s. 3(4)). The employee's signature is not compulsory, but it is worth having as an acknowledgement of receipt.

What are the deadlines?

The basic details within 5 days of the start date (s. 3(1A)) and the rest within one month (s. 3(1)).

Is a simple electronic signature enough?

Yes: the Electronic Commerce Act 2000 accepts any electronic signature, with the consent of the person receiving it, which is recorded at the moment of signing.

Can I ask for the PPS Number in the contract?

Best not to. Collect it through your payroll channel, which is the authorised route; it is not needed in the document to be signed.

What about a fixed-term contract?

The same as a permanent one: no particular form, and the statement of terms must give the expected duration.
